Der VORSITZENDE geht auf Veranstaltungen ein, an denen die Fachkommission CIVEX und ihre
Mitglieder mitgewirkt haben bzw. mitwirken werden, wobei er auf die Sechste
Subsidiaritätskonferenz hinweist, die am 18. Dezember 2013 in Berlin stattfand.
Graham TOPE (UK/ALDE) ergreift das Wort.
Ferner teilt der Vorsitzende mit, dass eine AdR-Delegation unter Leitung von Präsident
VALCÁRCEL SISO am 22./23. Januar 2014 Kiew besucht habe. István SÉRTŐ-RADICS
(HU/ALDE) und Mick ANTONIW (UK/SPE) ergreifen das Wort.
Der Vorsitzende weist auf die Konferenz für Bürgermeisterinnen und Bürgermeister hin, die der AdR
gemeinsam mit der GD Justiz veranstaltet hat, zu den Auswirkungen der innereuropäischen Mobilität
der Unionsbürger auf die lokale Ebene (11. Februar 2014).
Anschließend informiert er über den Zeitplan für die Erstellung der politischen Entschließung des
AdR, die auf der Plenartagung am 25./26. Juni verabschiedet werden soll, und bittet darum, ihm
schriftliche Anmerkungen bis spätestens 10. März 2014 zukommen zu lassen.

Luc VAN DEN BRANDE erläutert die Herausforderungen bei der territorialen
Dimension der Union für den Mittelmeerraum und die Errungenschaften der ARLEM mit
Blick auf die anstehende Plenartagung der ARLEM, die am 23./24. Februar 2014 in
Tanger stattfindet.

Der CIVEX-VORSITZENDE teilt mit, dass in der nächsten Sitzung der
Fachkommission CIVEX ein Bericht über diese Plenartagung vorgelegt wird.
Der Termin für die nächste CIVEX-Sitzung wird für den 7. April 2014 im Ausschuss der Regionen
in Brüssel bestätigt.

-8Appendix to the minutes of the 22nd CIVEX commission meeting
1. Agenda item 7
Debate on the draft EU Charter on Multilevel Governance
Luc Van den Brande (BE/EPP) presented the document he had submitted to the CIVEX
commission, in particular Appendix 1 thereof, which included a draft Charter for Multilevel
Governance in Europe (COR-2014-00234-00-00-TCD-TRA).
Béatrice Taulègne, Deputy Director for Horizontal Policies and Networks, presented the web pages
dedicated to the Charter, which would be added to the CoR website.
The chair opened the debate to the floor, clarifying that comments made at the CIVEX meeting, as
well as written comments received by the CIVEX secretariat no later than 17 February 2014, would
be summarised in a letter to the CoR President, in view of discussions to be held by the Bureau in
March and April1.
Mercedes Bresso (IT/PES) thanked Mr Van den Brande for his work on the draft. She stressed the
importance of this document in the context of the European elections, as it clarified the position of the
CoR in the EU governance structure. Acknowledging that the overall context was not favourable to a
new Treaty, she too supported the idea of a non-binding Charter. However, she stressed the
importance of strengthening the Charter, mainly in two ways:
(1) by examining how to ensure more effectively that the EU respected the competences of the
different levels of government in the constitutional systems of the Member States, inter alia through a
better definition of the subsidiarity principle, with specific reference to sub-national competences as
recognised by the respective Member States' constitutions or through a "multilevel governance
agreement" between the Member States and the EU institutions; and
(2) by considering whether infringements by EU legislation of sub-national competences, as
recognised by the relevant national constitution, should be considered as sufficient grounds to bring
an action before the Court of Justice of the European Union to annul an EU measure for breach of
subsidiarity.
In addition, Ms Bresso suggested that the Charter should be open to support from institutions (not
only people) representing all levels of government, i.e. local, regional, national, as well as the EU
institutions and intergovernmental organisations such as the Council of Europe. She nevertheless
insisted that people who pledged support for the draft Charter on behalf of their institution should be
duly mandated to do so, but admitted that verifying this condition could prove administratively
difficult.

Gediminas Paviržis (LT/PES) thanked Mr Van den Brande for his work. In his view, the Charter
could be instrumental to ensuring that subsidiarity was respected and that the competences entrusted
to local and regional authorities were matched by proper resources. He nevertheless suggested that
key concepts, such as "partnership", "multilevel governance" and "subsidiarity", should be defined
more clearly in the Charter so as to avoid any risk of confusion.
He stressed that the Charter should also emphasise the CoR's role in ensuring that the EU worked with
all levels of government to solve problems of direct concern to citizens.
Jesús Gamallo Aller (ES/EPP), considered the debate on multilevel governance to be a key aspect of
the CoR's core activity. At this critical juncture for the European project, the Charter could play a
positive role, particularly in view of the upcoming European elections. It would be a way to explain to
citizens how the EU institutional framework and decision-making process could be improved, and
how transparency and accountability might be ensured. He recalled that the recently adopted
regulation laying down the common provisions on the Structural Funds referred to multilevel
governance.
Regarding the signatories to the Charter, he was in favour of a process that ensured visibility,
transparency and accountability, following the example of the Covenant of Mayors.
Finally, Holger Poppenhäger (DE/PES) stressed that – in view of the commitments to be taken by
public authorities and of the concomitant need to implement these commitments on the ground – the
Charter should be clearly and unambiguously worded in all EU languages, which, he noted, was not
the case in German.
After Mr Van den Brande had responded to each comment, the chair reminded the participants that
the CoR president would be sent a letter summarising the discussion of the CIVEX meeting and
incorporating any other comments received from CIVEX members in writing, by the deadline set.
2. Agenda item 8
Hearing on the Eastern Partnership policy: the outcome of the Vilnius Summit, the future of the
Eastern Partnership and the role of local and regional authorities
Mercedes Bresso (IT/PES) expressed her gratitude to all CORLEAP members. She mentioned the
success of the Summit in Vilnius, held on 29 November 2013, which had been acknowledged by the
joint declaration. She emphasised some of the points made in the declaration, such as the significance
of point 50, which recognised the full role of local and regional authorities (LRAs) and civil society.
She referred to the CoR President's visit to Kiev, which sent a strong message about the possibility of
positive developments for Ukraine with the EU and discussed the role of CORLEAP.

- 10 Mamuka Abuladze (CORLEAP co-chair) presented the positive outcomes of the Vilnius summit, in
view of the prospect of Georgia signing an association agreement. He expressed satisfaction with
CORLEAP's activities so far and the intention to adopt an efficient and result-oriented action plan for
2014-2015. He also mentioned current work on funding sources and his intention to boost the
decision-making process at CORLEAP level.
Konstantinos Vardakis (EEAS) thanked the participants for the invitation on behalf of the EEAS
and mentioned that he appreciated the coordination role played by CORLEAP. He reiterated that the
main goal of the Eastern Partnership (EaP) was to provide support for reforms and underlined the
important role of everyone in the process. In this context, he pointed out the importance of LRAs in
two respects – the political and economic aspects. He also recognised the role of the Committee of the
Regions in this process.
His statement was divided in two parts – post-Vilnius steps to be followed and the role of the local
and regional authorities (LRAs). While stressing the lessons learned from Ukraine, he outlined ideas
for moving forward: continued differentiation between the partner countries; maintaining the EaP
multilateral track working method to increase the engagement of all the Member States with the EaP
countries; the EU's intention of enhancing the involvement of civil society; better public diplomacy
and visibility of the EaP initiative. The EaP countries' vulnerability to pressure from Russia also
needed to be taken into consideration. He underlined the importance of intensive EU-Russia dialogue.
In the second part, he stressed that there was no democracy without local authorities and emphasised
the contribution of LRAs to the process of concluding association agreements and their involvement
in and focus on implementation. He stressed CORLEAP's added value to capacity building. He
mentioned the EaP municipality flagship initiative. He also underlined the role of LRAs and
CORLEAP in shaping the EU bilateral perspective and emphasised the need to build closer relations
with Moldova and Georgia, which were to sign association agreements in August 2014, as well as
with Belarus and to follow up the implementation of the Association Agreements.
Antonella Valmorbida (CSF/ALDA) expressed support for democratic values in EaP countries and
outlined the achievements of CORLEAP in cooperation with the CSF. After providing a brief
overview of CSF activities, she emphasised the importance of broad dialogue when addressing EaP
countries, as well as the significance of value-driven EU intervention. She expressed her association's
readiness to contribute to the municipality flagship initiative and suggested carrying out joint training
with the CoR on fiscal decentralisation and territorial cooperation and a common seminar to be
organised in April with CORLEAP.
Mick Antoniw (UK/PES) expressed his concerns about the nature of the "dramatically changed"
situation in Ukraine, and stressed the lack of an efficient judicial and prosecution system to deal with
all the acts of violence and human rights violations. He believed that the current situation was a result
of the president's excessive powers. He also pointed out that the destabilisation of Ukraine had a
significant impact on Belarus, as well as on the EU. He called for broader and more imaginative ways
to address and involve Ukrainian civil society in the activities of CORLEAP.

- 11 Arnoldas Abramavičius (LT/EPP) referred to the lessons learnt and highlighted a failure in
communication. He mentioned the vulnerability and energy insecurity of the EaP countries. He called
for a specific approach to those countries and underlined the role that structures such as CORLEAP
could play. He stressed that a roadmap for the future could be found.
